1. Agreement to Terms

By accessing or using Orator's automation services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Service Description

Orator provides business automation solutions including but not limited to:

  • Workflow automation systems
  • WhatsApp bot development and integration
  • CRM integration services
  • Lead and sales automation
  • Custom business process automation

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

3. User Obligations

By using our services, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Accept all responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Not use our services for any illegal or unauthorized purpose
  • Comply with all applicable laws and regulations
  • Not interfere with or disrupt the integrity or performance of our services

4. Acceptable Use Policy

You agree not to use our automation services to:

  • Send spam or unsolicited messages
  • Violate any third-party platform's terms of service (including WhatsApp, CRM platforms, etc.)
  • Harvest or collect information about others without their consent
  • Transmit any malicious code or viruses
  • Engage in fraudulent activities
  • Infringe upon intellectual property rights
  • Harass, abuse, or harm others

5. Payment Terms

If you choose to purchase our services:

  • You agree to pay all fees associated with your selected plan or custom project
  • All fees are non-refundable unless otherwise stated in writing
  • Payment is due as specified in your service agreement or invoice
  • We reserve the right to suspend or terminate services for non-payment
  • Prices are subject to change with 30 days notice

6. Intellectual Property

The automation systems, code, documentation, and all other materials provided by Process Pilot remain our exclusive property or the property of our licensors. You are granted a limited, non-exclusive, non-transferable license to use our services solely for your business purposes.

Custom automation solutions developed specifically for your business will be owned by you upon full payment, unless otherwise specified in a separate agreement.

7. Service Level and Availability

While we strive to maintain high availability of our automation services:

  • We do not guarantee uninterrupted or error-free service
  • Scheduled maintenance will be communicated in advance when possible
  • We are not responsible for third-party service outages (WhatsApp, CRM platforms, etc.)
  • Service level agreements (SLAs) may be available for enterprise clients

8. Data and Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your data as described in our Privacy Policy. You retain ownership of all data you provide to our automation systems.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Orator shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid by you for the services in the 12 months preceding the claim
  • We are not responsible for any business losses, lost profits, or data loss
  • You acknowledge that automation systems may occasionally experience errors or bugs

10. Third-Party Integrations

Our services integrate with various third-party platforms. You are responsible for:

  • Maintaining valid accounts and licenses for all integrated platforms
  • Complying with the terms of service of all third-party platforms
  • Understanding that we are not responsible for changes to third-party APIs or services
  • Accepting that third-party service disruptions may affect our automation services

11. Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Non-payment of fees
  • Fraudulent or illegal activity
  • Actions that harm Process Pilot or other users

Upon termination, your right to use the services will immediately cease. You may cancel your subscription at any time through your account settings or by contacting us.

12. Indemnification

You agree to indemnify and hold harmless Orator, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or data processed through our automation systems

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Process Pilot is registered, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through our service. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

16. Severability
